Commercial Conveyancing

Commercial Conveyancing applies a practical approach to a range of commercial conveyancing topics. The course book introduces key organisations and sets out the underpinning landlord and tenant law. It covers key documents, including the content of commercial (FRI) leases, and highlights key regulatory matters relevant to commercial conveyancers.   Preliminary matters, including tenant references and guarantees are discussed. The law relating to when the landlordâ€s consent for dealings is required is described. The basic requirements of key taxes are set out, including stamp duty land tax and corporation tax on capital gains.  The provisions for security of tenure under Part II Landlord and Tenant Act 1954 are explained, including the provisions for opting out. The conveyancing steps for a commercial conveyancing transaction are then set out, including taking instructions, investigating title, drafting the contract, searches and enquiries, planning considerations, financing, exchange and completion.  Finally, recent and proposed reforms are outlined.  The book is supported by a number of activities and links to practice which reflect the authorâ€s wide-ranging experience in commercial conveyancing.  Commercial Conveyancing is the recommended textbook for the CILEX Professional Stage Commercial Conveyancing module, but it will also provide invaluable guidance for law students and other practitioners who are seeking to develop and update their practical and commercial skills in this area.
